When it comes to finding a law firm that puts their clients first, it seems difficult to find an office that follows this virtue. However, this was not the case when dealing with Lawfty Law. They exceeded my expectations as their staff members were very respectful, professional, and most importantly, timely with their response. The office’s transparency makes them a family friendly office. Although I was distraught coming to the office with my case, Pablo assured me that I was in good hands. 10/10 recommend to anyone in the DMV.

What you should know about injury claims in Pennsylvania

Essential information about personal injury claims in Pennsylvania to help you understand the legal process with confidence.

If your question isn’t answered here or you’d like tailored guidance after an injury, schedule a free consultation.

What is the statute of limitations for personal injury claims in Pennsylvania?

Under Pennsylvania law, you generally have two years from the date of injury to file a personal injury lawsuit. This includes cases such as car accidents, medical malpractice (with some exceptions), wrongful death, product liability, assault, and slip-and-fall incidents. The statute of limitations typically begins on the date the injury occurred. Failing to file within this timeframe typically results in losing your right to pursue compensation. However, there are important exceptions to this general rule such as the discovery rule, where if the injury or its cause is not immediately apparent, the two-year period may begin when the injury is discovered or should have reasonably been discovered.

Due to these deadlines and possible exceptions, it's important to consult an attorney soon after an injury to ensure your claim is filed on time and your rights are protected.

How does Pennsylvania’s comparative negligence law affect my personal injury claim?

Pennsylvania follows a modified comparative negligence rule, often referred to as the "51% bar rule." The comparative negligence law allows you to recover damages even if you share some blame for your injury, as long as your fault does not exceed 50%. Your compensation will be reduced in proportion to your degree of fault, but if you are found more responsible than the other party (over 50%), you may not recover damages at all.

Why should I hire a personal injury lawyer for my case in Pennsylvania?

Hiring a personal injury lawyer means having someone who understands Pennsylvania law and knows how to file your claim properly and within the statute of limitations. They can accurately estimate what your case is worth, including medical bills, lost income, and pain and suffering, so you don’t get shortchanged. A lawyer also takes the stress off your plate by handling the legal and insurance details, allowing you to focus on healing. Overall, having experienced legal support greatly improves your chances of a successful outcome or fair settlement.
