What is the statute of limitations for personal injury in Massachusetts?

In Massachusetts, most personal injury claims must be filed within three years from the date of injury under Massachusetts General Laws Chapter 260, Section 2A. Missing this deadline generally eliminates your right to pursue compensation. Exceptions may apply in certain circumstances, including claims involving minors and cases where an injury was not immediately discoverable. Early legal assessment helps preserve all available options.

How does Massachusetts comparative fault law affect my claim?

Massachusetts follows a modified comparative fault rule with a 51% bar. You can recover compensation even if you share some responsibility for what happened, provided your share of fault does not exceed 50%. If you are found 51% or more at fault, recovery is barred. Where fault is shared at 50% or below, compensation is reduced in proportion to your share. How fault is documented and supported from the outset of a claim has a direct bearing on the final outcome.

What damages can I recover in a Massachusetts personal injury case?
